[Vid + Info] TVXQ Trial Court Decisions

3 popular group TVXQ members, Jaejoong, Yoochun, and Junsu are now be able to be more active individually in separation of the group activities.

The court acknowledged the main point of the case is the problem in their belonging exclusive contracts which bring the ripple that is generally known as “slave contract”.

In regard of TVXQ Jaejoong, Junsu, and Yoochun, the Seoul Central District Court issued a temporary injunction to stop the effect of the exclusive contract, “SM could not point the members to do activities they’re not willing to, and SM also can not disturb the individual entertainment activities, “he decided.

Sang-Hyuk Lim / TVXQ legal representative for the members:
“Up until now the problems in the contract we always argue about are about the length of contract period, revenue-sharing issues, and financial penalties. I keep certified our claim to these problems, and I am very glad for the decision.”

The court, as considering the fact that the members could sustain group activities, therefore they agreed not to fully terminate the exclusive contract effect. However, the lawsuit that was filed by TVXQ members is to fully terminate the exclusive contract effect.

other the info that is explained more in this video:

1. 3 TVXQ members side are welcome to the court decision, yet they’re still going to bring an action for damages against the unfair distribution of income. >> to settle about unfair distribution income problem (claim number 2 — see the red fonts above)

2. As now 3 TVXQ members have more rights to choose what they want to do and what they dont want to do, in spite of the Court also thinks that 13 years period of contract is an excessive length in a contract period, however, they don’t find it a big fuss anymore about the matter. >> Court rejects to approve (claim number 1), about contract period. As for penalties (claim number 3), there should not be any penalties involved as so far the 3 TVXQ members agree not to leave SM

3. Regarding the income issue, a fierce legal battle is now expected to continue.
