[News] More Info Regarding 091027 Courts Ruling On TVXQ-SME Trial
Let me summarize the current situation right now in more simple words?
1. Seoul District Court is so far favoring JaeChunSu side. They partially accepted the exclusive contract suspension the trio have been submitted. The partially accepted here so far only mentioned about the three members now can have their right to decide whether they will take one job or not. So the three members are now like 3rd parties to SM. Said that with this decision, TVXQ activities as five members will lay on three members‘ decisions, and not SM Entertainment.
2. With the point that TVXQ activities as group can still be continued, thus Court couldn’t terminate the clause about income distribution (which I’m a bit blurred here~however not in any line there’s a say that Court already deals with the unfair distribution income nor the length of contract).
3. SM is NOT YET saying anything about accepting or refusing this decision. They still said in their press release today, “About our exact official stand, we will inform it soon.”
4. The three members also have not fully agreed with the current decision. However, they’re now preparing to settle matter with SM regarding the existing payment settlement to prevent another unfair payment in the future, as well as the fact that they haven’t received any payment from SM since February this year, and another remaining issues about income distribution.
5. If both parties finally agreed with this, it’s much probable that JaeChunSu will stay at SM, yet with more independent decision rights, and — if the negotiations about income distribution runs smooth — also with more fair income distribution.
6. This is NOT final decision. As SM hasn’t said anything and the main point of this case, the income distribution is not yet solved.
My suggestion is… just stay back for a while and read everything carefully. Don’t throw any judgment before everything’s clear. You don’t know what’s happening behind the curtains~ you also don’t know how much HoMin position could influence the will of three members to continue the case. [News] Court Rules Partial Provisional Disposition of Exclusive Belonging Terms for TVXQ’s Contract with SM Ent

The court has gave out the final ruling on the lawsuit between the 3 members of Dong Bang Shin Ki and SM Entertainment.
Seoul Central Court revealed on 27th October a citation of their ruling for the lawsuit between the SM Entertainment and TVXQ Hero JaeJoong, Xiah JunSu and Micky YooChun.
It was revealed, “We see that part of the terms in their contract has much destroyed the good morals of the whole contract. SM Entertainment should not interfere with its singers’ independent unique activities and also contract to perform and other entertainment activities.”
Previously in July, the 3 members of Dong Bang Shin Ki has revealed their 13-year long contract under SM Entertainment, which meant that they will possibly be working under SM Entertainment for life, and has applied for the effect of provisional disposition of the terms in their contract. And the 2 parties have engaged in a lawsuit as SM Entertainment insist that the terms under their contract are reasonable.
The court also revealed, “Through the individual agreement, there is high possibility for group activities to continue, but for the provisional disposition of the existing activities and the profit allocation, it is invalid and difficult. We will have to dismiss the application for the full provisional disposition of the effects of the exclusive belonging terms in the contract.”
The court ruled partial disposition of the exclusive contract terms – to dispose of the SM Ent’s interference to the members’ independent unique activities and also contract to perform and other entertainment activities

this the news that I read in soompi the courts in favor of the boys, and they stated that the boys should be able to be more independent (meaning they can reject schedules that SM proposes and can do their own businesses without interference) but not move companies (meaning all the boys will be under SM!) Popular group member TVXQ Xiah Junsu’s twin brother Kim Junho is preparing for his debut artist.
Recently Kim Junho was seen in one of training building in Kangnam, Seoul, South Korea to have his singing rehearsal which is focused more on vocal training.
Xiah Junsu was also said to ask his vocal trainer, The One to give Junho the training. According to one official, “Junsu asked The One to give his elder brother a vocal lesson,” he said.
Kim Junho appeared the first time in front of Korean public at the end of last year in MBC’s show “Introducing Star’s Friends”. Being 188 cm tall, Kim Junho was a baseball pitcher in one Korea University. Due to his well built body and handsome look, he became popular real soon and was recruited as one milk company’s CF model. Kim Junho specially becomes a topic for his outter appearance which resembles actor Jo Han-sun.
To prepare for his debut, Kim Junho was said to receive acting classes for 3 years in Korea. He also learned about music and how to stand on musical stage during the period.

[News] 091017 SS501: “About Dong Bang Shin Ki, because we are colleagues it is saddening”
SS501 expressed their feelings about group Dong Bang Shin Ki amidst this time where they are in danger of disbandment.
During their 1st Asia concert tour Persona concert press conference in Taiwan Taipei on 17th October, SS501 said, “Dong Bang Shin Ki is the representative group in Korea, and now that they are in such an uncertain time, as colleagues we feel sad about it. We hope that the situation will turn out well eventually.”
SS501 and Dong Bang Shin Ki have been put in comparison since the 2 group’s debut. But recently with the ongoing trial between the 3 members from Dong Bang Shin Ki and their management company, SS501 has also shown concern to the situation.

Early morning of 15th October, there was a girl named Kurosaki Ayano from Tokyo, together with three of her friends, who was shopping for souvenirs at a huge mall in Seoul station.
Kurosaki Ayano and friends decided to visit Seoul after seeing the ‘Infinitely Yours, Seoul’ CF on TBS. The scenes of Dong Dae Mun market and Dong Bang Shin Ki’s performance had left a deep impression on her.
The advertisement Kurosaki Ayano saw was the ‘Infinitely Yours, Seoul’ Japan version done by Seoul City Council on June this year. It was an advertisement that Dong Bang Shin Ki was in. It is one of the four different versions used promoting Seoul tourism. Other advertisements include China, Japan, South East Asia and USA. These four different advertisements had cost 13 billion won, and 90 billion won go to the endless broadcast on all media of almost 20 different countries around the targeted regions.
According to related data, Seoul City Council spent 401 billion won for advertising tourism overseas, and 339 billion won this year. Marketing officer from Seoul City Council stated, “Tourism and investment are closely related which directly affect the overseas sales.”
Seoul City Council uses TV advertisements, newspapers and the internet as their promoting media.
So how successful has this round of advertisement been? Through investigations from China, Japan and Bangkok last year, Seoul comes in first for the ‘Most Desired Vacation Destination.’ According to the data from the Cultural and Education Department, the number of tourists that visited Seoul had increased from 413 million (2007) to 513 million (2008).

[News] 091017 Campaign to Boycott All Products by SM Entertainment, Inc. (Updated)
As many of you know, the contract with which SM has bound TVXQ is an unconscionable “slave contract.” Under the contract, the members have virtually no rights. They have no right to know the specifics of the terms that they are subjected to. They have no right to argue for themselves their rightful compensations or the musical directions they want to pursue. They also have no right to refuse the work that SM assigns them, which leads to a grueling work pace that permits only a few days of rest per year. Most egregious of all, the members are stripped of their right to escape the contract by paying fair damages, although SM retains their right to terminate the contract at will.
In August of 2009, the members of TVXQ filed for an injunction to nullify this slave contract. SM retaliated by manipulating the press to spread malicious and false rumors about TVXQ. SM also showed its disregard for both the fans and TVXQ’s personal commitment to them by blocking TVXQ from participating in a long-waited Korean concert (SM Town Live ‘09).
However, now that the legal battle has continued for a few weeks, SM has unashamedly turned to squeezing every dime out of TVXQ in order to hoard the money with which to fight the members in court. In contrast to the disregard it showed to TVXQ’s Korean fans, SM has hosted a concert in China since the filing of the injunction (Shanghai in October ‘09) and plans to host another one soon (Shimcheon [I think they mean Shenzhen] in November ‘09). SM has also created and begun to sell its merchandise in Japan. Additionally, SM has announced that it will release several new products that market TVXQ in the next few weeks.
We understand that all income that SM generates from now on will be used as weapons against TVXQ. The fans have already given too much money to SM without it benefitting the members themselves. To vindicate the rights of the members and the fans, the fans have launched a boycott against all SM products.
Please participate in the boycott and refrain from buying and giving money to any and all SM merchandises and businesses. The money that we give SM to buy TVXQ products will be turned around to injure TVXQ.
GUIDELINES FOR THE BOYCOTT
All products produced by SM Entertainment are subject to the boycott. Specifics are enumerated below.
A. Any product marketing TVXQ that is produced in Korea is subject to the boycott. This includes Korean singles, live and regular albums, photos and photobooks, merchandise, concert DVDs, original character products, and any other products manufactured by SM Entertainment.
B. All Japanese singles and albums that are LICENSED BY SM are essentially Korean products and should be boycotted.
C. All other kinds of music products, such as individual songs available for downloading and streaming, BGMs for websites, answering tones (known as “coloring” in Korea), and ringtones are subject to the boycott.
D. Singing TVXQ songs in kareoke generates income for SM and therefore should be refrained from.
E. All other business enterprises related to SM should also be boycotted. They include: i) Restarants: Ashley, Podonamu, E-table ii) Karaoke service: Everysing iii) Clothing store: SPAO
F. SM merchandises that have bypassed AVEX Entertainment and are directly sold in Japan are also subject to the boycott. Please do not confuse them with AVEX products.Examples of these exorbitantly-priced merchandises include: i) All about TVXQ, sold for approx. $200 ii) “clear files,” sold for approx. $50
PLEASE NOTE THAT ALL PRODUCTS RELEASED BY “AVEX ENTERTAINMENT” ARE NOT SUBJECT TO THE BOYCOTT. Please continue to purchase them.
Japanese singles, albums, and DVDs come in two varieties: those released by AVEX (the so-called Japanese or Hong Kong versions) and those licensed by SM (the so-called Korean versions). We encourage that you purchase the former, but please refrain from buying the latter. 100% of the money used to buy SM-licensed products, even if they are Japanese, goes directly to SM.
The fans should continue the boycott until 1) the unconscionable slave contract between SM and TVXQ is bettered to the satisfaction of our members and 2) we as consumers have found a voice against SM.
Again, please remember that all money that goes to SM will be spent on injuring our dear members. Your choice to boycott will make a difference!

The source came from a Chang Min fan cafe (chflc) and it was from the same person who posted the info about Chang Min having dinner with the PD not long ago. They said that Lee Yeon Hee is once again being confirmed as the lead actress for PM. Production has been lined up for the two as of the 16th October. DongBangShinKi attended the court for an agreement but failed.
TVXQ’s Hero Jaejoong, Micky Yoochun, Xiah Junsu submit today in court, despite the court’s mediation efforts to reach a consensus.
In the past three months, DBSK members and SM Ent attended at the Seoul Central District Court to coordinate the process of the case. The court agreed that both sides should come up with an amicable decision but because of the differences between each other, the agreement did not end the conflict.
For TVXQ “They have the deep feeling that their goal which is changing their work conditions seems to be difficult to reach”.
The court is planning to make a difficult decision for both sides later in the month.
Meanwhile last July 31st, the 3 members of Dong Bang Shin Ki 3 filled an exclusive contract validity suspension and provisional disposition request.

[News] 091013 Court Mediation Failed. The Court Decision will Release Soon
The three members of group TVXQ who have unfair contract dispute with their agency SM Entertainment presented at the court secretly was confirmed on last October 13th, however had failed to reach agreement with SM. Previously on October 12th, the two side had submitted a final official stand documents that have been required since early this month for review to make final decision.
At the end of July this year, 3 TVXQ members (Jaejoong, Yoochun, and Junsu) filed their disposition application to Seoul Central District Court to terminate the exclusive contract effect against SM Entertainment. Reportedly in last month on the 30th at 4 pm just before Chuseok, wearing sunglasses, the members entered hurriedly to the side entrance of the court building. They secretly received report about the trial request date and other information regarding the case was not disclosed. There was no appearance of the fans, and even most of court staffs couldn’t recognize the three members who disguised themselves just like ordinary civilians and they could move without any fuss.
On August 22nd the legal representative of the 3 members forwarded members’ thought to the court, “We found it very difficult to improve and reach our goals in this industry if we live under SM’s management with all its terms and conditions.”. It’s also reported that, “The arguments happened with SM Lee Soo Man regarding this dispute already reached our highest limit of emotion.” Meanwhile regarding the other two members who don’t participate in the legal case and still have listed activities with SM, was said, “It’s not possible to breakdown a group of 5 people who actually still want to work together.” showing their intention to keep shinning together as a group.
After the failure of past mediation between two sides, court won’t summon the 3 members any further and will make its final decision soon.

Recently in Japan, the main keyword/stars for Hanllyu (Korean Wave) is the 5 member Idol group TVXQ. Last week, TVXQ swept away 2 #1’s in 2 categories on the Oricon Chart, which can also express Japan’s popular artist’s popularity most accurately. It is clear that TVXQ’s a top star in the J-Pop industry.
Recently (30th of last month), the news of their release of the ‘4th Live Tour 2009 ~ The Secret Code FINAL in TOKYO DOME ~’ DVD, which sold about 171,000 copies ranked #1 on Oricon Weekly DVD Ranking became a huge topic. It was because it was the first time a Foreigner who is Asian had ranked top in the DVD/Video category.
On the same day, TVXQ’s member Hero Jaejoong & Micky Yoochun who formed a special unit ‘JEJUNG & YUCHUN ’ with their single ‘ Colors ~ Melody & Harmony ~ / Shelter ’ ranked #1 as well, with 149,363 sales in just the first week. To accomplish this much with just 2 members, is proof of TVXQ’s Popularity in Japan.

● The difference & attraction between THSK & JE Idol
It is not an overstatement when you say that groups from Johnny’s (focuses on male idol groups) have a tight grip on Japan’s male idol market. For many years, Johnny’s have specialized and focused on male idol groups by debuting many groups fitting Japanese women’s tastes.
Johnny’s group Arashi, Smap, NEWS, Kinki Kids, Tokio, V6 etc, who are also known in Korea, have been on top of music charts, movies, shows etc(in Japan). Because of this, in 2005 with their debut single “Stay with me Tonight”, many people did not think or expect THSK to get results like they have today.
However, THSK showed a different charm to those females who have been so used/accustomed to Johnny’s boy idols. It was that they were a group with both singing and dancing talents. This is also similar to when BoA caused a big stir in the Japanese female idol market earlier in 2000.
Instead of vocal skills, Johnny’s Idol groups are focused more on performance and image making, and have captured female fans with their looks. You can notice that many of them have/use a nasal sound and aren’t vocally skilled, but with their image, made from their appearances in a variety of programs, drama, movies etc, they have captured many fans and is why they are at top in the music industry.
Since their debut in Korea, TVXQ has been known as an “Acapella Dance Group” and have proved so with their harmony, and excellent live performances. Also, another big part of an Idol’s popularity is dance, (such as hip hop, jazz dance, etc.) which U-Know Yunho (also TVXQ) are skilled in. TVXQ’s performances overpower Johnny’s Artists performances because of the diverse/variety of performances they perform.
Unlike Johnny’s Group, who are elegant, skinny, and the pretty faced type, which Japanese women like, TVXQ was more focused on bringing out each members individuality/personality and at the same time, with their tall heights, their fit bodies through exercise etc. they emphasized on manliness.
● One step at a time… continuous challenge to the top
In less than a year, BoA became a top star in Japan. In 2002 with her first album “Listen to my Heart” which sold nearly 1 million copies, ranked #1 on the Oricon Weekly ranking which was a big topic in both Korea & Japan.
The biggest success achieved for a Korean singer that debuted in the J-POP industry, would be BoA. From the start, it was solid that BoA was to debut in Japan. Because of this, she was able to understand the Japanese culture as well learn the language and was able to guest on variety of programs without giving a feel of a foreigner. This was one of key factors that gained BoA’s big popularity amongst the people.
But, THSK was different from BoA. They were not proficient in the language, and nor did they mainly focus on their Japanese activities, which took longer for them to rise to the top. Their first #1 on Oricon Daily Single chart was in 2008 with their 16th single “Purple Line”.

MBC Drama Series “Heading To The Ground” will take its early ending bell on the 5th next month.
Initially “Heading To The Ground” is agreed to have 20 episodes broadcast time, however it will be cut to only 18 episodes instead.

[News] 091012 Final Written Official Stands Submission
According to officials about the recent exclusive contract conflict issues against SM Entertainment (SM) involving 3 TVXQ members Jaejoong, Junsu, and Yoochun, both side will need to launch the final written official stands as for today.
The law firm official that is representing 3 TVXQ members on October 12th had a phone call with MtStar News, “The court told me that today is the last day to submit official stand documents for both parties. So today is the last chance for both sides to strengthen each other side’s defense in written document.”
Seoul Central District Court announced that last August 21st was the deadline of submitting papers required from the 1st hearing that was already represented on last September 11th trial, however due to large documents submission from both sides and time limit pressure, the final deadline to complete the documents was determined as in today.
The official also said, “After the last submission of official stands document today, sooner or later the court’s decision of unfairness long term contract matter will finally be released.”
The three members of TVXQ filed a disposition application to terminate exclusive contract effect to Seoul Central District Court on July 31st against SM Entertainment. To verify income information, there is evidence preservation application that has been confirmed needs to be submitted.
However in this case the leader U-Know Yunho and the youngest Choikang Changmin did not participate.
And too many parties — from government to politicians — have thrown out opinions and comments that I believe at certain extent will influence the court’s judgement.
Most of the opinions are in benefit of DBSK side, however, the worst thing of all is.. what’s happening to our boys is how’s the Korean entertainment actually working (through surveys conducted in Korea itself). [NEWS] TVXQ's Impressive Fans! Performances By All 5 Erase Rumours Of Disbandment - Shanghai
On 2009.10.02, TVXQ, South Korea's 5-member vocal group, held their concert "TVXQ THE THIRD ASIA TOUR CONCERT - MIROTIC" in Shanghai's Hongkou Football Stadium. Reported on the 3rd by the Shanghai Paper and the Dong Fang Daily.
On that day, in the areas surrounding the venue, there were many vendors selling TVXQ goods, and with so many fans swarming there, there was a temporary congestion. Within the arena, it was filled with the red pen lights of the audience, and when the red pen lights moved in tandem with the songs, it was a spectacular sight. Also, when it came to the members' solos, the lights would change into different colours that represent the members when they appeared one by one, for example, green and purple, and the entire venue was surrounded by a fantastical atmosphere.
In Chinese, Yunho shouted "Happy Mid-Autumn Festival!" and Jejung looked into the screen and asked "Did you miss me?" and drew roaring cheers from the fans. When the concert started, they were shouting "Don't stop! Don't disband!", and at the end of the concert the audiences held up banners that had "I believe (midoyo)" in Korean written on them, and the fans were an impressive sight as they kept on chanting "Midoyo" right till the end.
TVXQ Jaejoong, Yoochun and Junsu who had submit a request for the relevant documents for the hearing is on hold, although Seoul district court had accepted the 3 members request to get evidences relating to this hearing, however, it is said from a SM representative, they're given 20 days in notice to produce all relevant documents which was supposed to be submitted on the 26th, wasn't submitted.
The 3 members had requested for this, because they felt that these documents would be the best evidences to show their unfair treatment from SM on the 21st August hearing; it was one of the most important evidences. The judge then expressed "after checking through the documents that would submitted on the 26th, we'll then hold another hearing which would take place 3 weeks later, 11th Sept."
The relevant documents include THSK activities payment, contract and more, these documents could be used against SM who had claimed that after TVXQ debut of 5years, they had earned up to 498 billion won and however SM has a earning of 1487 billion won, this can be said that the above documents is to check the details of each earning. During this period, TVXQ fans had found flaws in the sales of the albums, and like the court, the fans are wondering too, how much did TVXQ exactly earn within these 5 years, and this had created quite a stir in the society.
SME accepting this request was difficult too. because if they were to release the said documents which includes SME investment in the trainings etc; it could eventually reveal the methods they had used to train their trainees which they named it as the "top-secret documents". Representative had said "SME is a up-trend company, who had compiled all financial status and revealed it to the necessary people, therefore, to give out the information that the 3 members had requested are really tough."
Majority of the fans expressed that they had been suspicious of the earning of TVXQ during this 5 years. Their earning goes by the sales of album, activities, CF, there's also SM yearly album, DVD and more which could say that these sales are earning them billions. fans had submitted a petition on the 28th saying the unfairness of contract had invaded the rights of TVXQ and this had created pressure in SME.
Although TVXQ and SME are having conflicts, and of this money conflict, this created a "reality game", and in the near future, this war might still continue for a little while more.
The Preservation of Evidence request that TVXQ's YoungWoong Jaejoong, Micky Yoochun and Xiah Junsu has not been followed through.The Seoul District accepted the three members' request and asked their agency SM Entertainment to hand in all documents relevant to this trial. However, it has been found that SM has not hand in these documents even though the 20 days the Courts gave them expired on the 26th.
These documents are crucial as the Courts even stated at the first hearing on the 21st that they needed documents relevant to this trial to come to a decision. The Courts stated, "After going through all the documents that must be submitted by the 26th, the Courts will come to a decision three weeks later on September 11th."
This is because these documents will determine whether SME's claim that TVXQ earned 49.8 billion Won as well as their claim that SME earned 148.7 billion Won is true or not. This means that TVXQ's income and output will all be revealed. Many fans have stated that the amount SME stated was TVXQ's total earnings was very questionable. A lot of attention was focused on the trial as many believed they would be able to reveal and eliminate all monetary problems and rumors about the agency and the group.
But in truth, it is hard for SME to adhere to this request. If SME submits all documents including account books, receipts and transaction, all their expenses and true income will be revealed. The secrets that may be revealed include 'company secrets' that SME has developed over the years to debut singers.
One representative said, "We have already shown as much as we can for this trial. It is impossible for us to hand in all our documents relevant to this trial."
Many fans have stated that the amount SME stated TVXQ earned was very questionable. They say that all the money from albums, events, CFs, photobooks, DVDs, and other services adds up to a staggering amount. Fans handed in a petition to the Human Rights Commission of Korea on the 28th stating that SME was violating the human rights of TVXQ with their exclusive contract.

The decision regarding the legal dispute between three members of TVXQ and SM Entertainment will be made this month.
TVXQ Xiah Junsu (Kim Junsu). YoungWoong Jaejoong (Kim Jaejoong), Micky Yoohun (Park Yoochun) and SM Entertainments conferences to reach an agreement have broken down altogether.
In a phone conversation with Newsen on the 15th, the Courts stated, “Both sides submitted all relevant documents by September 11th. Both sides are not willing to back down from their positions so a mutual agreement doesn’t seem likely to occur any time soon,” and “After all the documents have been read and examined, both sides will be told of the results. We are not certain, but the decision will be made this month.”
TVXQ’s three members have been waiting for the verdict since September 11th when they submitted all documents relevant to the exclusive contract suspension request they filed against SM Entertainment. At the hearing, the Courts stated, “We will end the hearing for now and both sides must submit all relevant documents by September 11th which is in three weeks. We will examine these documents and come to a decision.”
An SME representative stated, “After submitting all documents in by the 11th, there is nothing we can do but wait. We do not know when exactly the verdict will be given.”
